Assumption of Risk: I understand that using the batting cage involves inherent risks, including but not limited to the risk of being struck by a baseball or softball, injury from the use of equipment, or accidents occurring in or around the batting cage area. I fully assume all risks related to my participation in batting cage activities, including those caused by negligence, whether active or passive, on the part of the Diamond Edge Baseball and its employees.
Release of Liability: In consideration of being allowed to use the batting cage and participate in related activities, I, for myself, my heirs, executors, administrators, and assigns, hereby release and discharge Diamond Edge Baseball its owners, officers, employees, agents, and affiliates from any and all claims, demands, actions, and causes of action for any personal injury, death, property damage, or other loss arising out of my use of the batting cage, even if caused by the negligence or other fault of Diamond Edge Baseball.
Indemnification: I agree to indemnify and hold harmless Diamond Edge Baseball its owners, officers, employees, agents, and affiliates, from any and all claims, lawsuits, damages, losses, liabilities, or expenses (including legal fees) arising from or related to my use of the batting cage, including injury or harm to myself or others. This indemnity applies whether such claims arise from my own actions or the actions of others, including employees of Diamond Edge Baseball.
Health and Fitness: I confirm that I am in good physical health and have no medical conditions that would prevent me from safely participating in batting cage activities. If I have any health concerns or medical conditions that may affect my ability to participate, I agree to inform Diamond Edge Baseball prior to use of the batting cage. If I am under a physician’s care for any medical condition, I affirm that I have obtained medical approval to participate in batting cage activities.
Compliance with Rules and Instructions: I agree to adhere to all posted rules and regulations governing the use of the batting cage, as well as any additional instructions provided by the staff of Diamond Edge Baseball understand that failure to follow these rules may result in my immediate removal from the facility, and I waive any claims against Diamond Edge Baseball that may result from such removal.
Photo and Video Release: I consent to the recording of my image, voice, and likeness during my participation in activities at Diamond Edge Baseball, and I agree that these recordings may be used for promotional, marketing, or other lawful purposes by Diamond Edge Baseball, without compensation.
Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, and any disputes will be resolved within the jurisdiction of Alberta courts.
